MEDIA SILENCE ENABLES LOCAL OFFICIALS’ INCREMENTAL MILITARIZATION OF LAW ENFORCEMENT

     Dona Ana County Detention Center (DACDC) in Las Cruces has been notorious for years, if not decades, for mismanagement, fiduciary deficiencies, and carceral abuses.  On 16 October, a lawsuit brought by the American Civil Liberties Union (ACLU) on behalf of six detainees added to its notoriety.  On that date, KTSM and KVIA/ABC, two El Paso television stations, posted reports on that lawsuit.  On 20 October, I distributed my blog, “ICE-Like Abuses at Dona Ana County Detention Center Implicate County and Center Leaders,” to over 300 people and posted it for many more.

    County Sued By ACLU for Prisoner Abuse, Data Center to Pay.

    The American Civil Liberties Union has filed a lawsuit against the Dona Ana County Commissioners alleging that a special County paramilitary unit has for years been attacking prisoners in the County Jail under the guise of training. According to the suit, members of the unit, designated the Special Operations and Response Team (SORT), conducted surprise assaults on prisoners by bursting in upon them while they are engaged in innocuous activities such as watching TV or playing cards or asleep. The attacks begin with a flash bang grenade, followed by armed paramilitary officers rushing in and loudly shouting conflicting commands. Prisoners, some of whom are awaiting trial and have not been convicted of anything, are tasered if they show any sign of not obeying.

    Six former prisoners are plaintiffs in the ACLU suit, but it seems likely more will join the suit as they become aware of it. Damages have not been specified yet, but will likely be enormous.

    County Commissioners, who are in charge of the jail, have not released any statement regarding the suit, but one Commissioner told this reporter, “We knew this was coming. That’s why we made that crazy deal with Project Jupiter. They will give us $13 million every year, we will add a couple million more to the pot and pay it out to the plaintiffs. In thirty years it will be all paid off, so no harm done.”

    Commission Chair Christopher Schaljo-Hernandez has said he is mostly worried about how the elite Gestapo-like special force will be able to train if they can no longer subject prisoners to cruel and inhumane treatment. But, Schaljo-Hernandez has proposed a solution that he thinks will work. Schaljo-Hernandez, part owner of the restaurant Salud, has said the storm troopers can practice on his staff.

    “Suppose an employee starts to leave the restroom without washing his hands,” says Schaljo-Hernandez, “It’s flash, bang, get on the floor maggot and crawl back to the sink.” Schaljo-Hernandez admits that it might slow down service a bit, as it takes a few minutes for a waiter to recover from being tasered, “but, you know hygiene is important in the food service industry.”

    “When you think about it, our employees need their jobs. We have several former software engineers from Amazon and three or four MBAs downsized by AI. They’re desperate to keep their jobs, so they are in a sense prisoners. And, if they complain, it’s flash, bang, ...you know the rest”

    "We may even expand the program to include customers. Complain about the service and you get a hood over your head and hauled off to a back room for tasering. Problem solved."

    But, some civil libertarians have said the plan might incur even more liability on the part of the County if restaurant employees are hurt by the County Storm Troopers. Schaljo-Hernandez answers by pointing out that injuries incurred while at work, including PTSD, are covered by workman’s comp. “It won’t cost us a cent,” says the Commissioner. “And, if we do get sued, we can always approve more data centers.”
